1Introduction
These Terms and Conditions (“Terms”) govern the access to and use of the Burger Farm mobile application (“Application”) operated by Burger Farm India Private Limited (“Burger Farm”, “Company”, “we”, “us” or “our”).
The Application enables eligible users to browse menus and place orders for food and beverages offered by participating Burger Farm outlets for takeaway, dine-in and Mobile Drive-Thru collection, subject to the availability of such services at the selected outlet.
By downloading, accessing, registering on or using the Application, the user (“User”, “you” or “your”) agrees to be bound by these Terms, together with the applicable Privacy Policy, Refund and Complaint Policy, Farm Wallet Terms and Conditions, Loyalty Programme Terms and Conditions, and any applicable promotional terms. If you do not agree to these Terms, you must refrain from using the Application.
2Eligibility and Account Registration
2.1The Application may be used only by individuals who are at least eighteen (18) years of age and reside in India.
2.2Registration and account access shall require a valid mobile number capable of receiving a one-time password (“OTP”) for verification. One account shall be associated with one mobile number only.
2.3The User acknowledges that the registered account may be active on only one mobile device at a time. Logging in to the Application on a new device may automatically log out the account from the previously used device.
2.4The User shall provide accurate information during registration and keep their account details updated. Burger Farm reserves the right to restrict or suspend accounts where the information provided is false, misleading, fraudulent or otherwise in violation of these Terms.
2.5The User shall be responsible for maintaining the confidentiality of OTPs and securing the device used to access the Application. Burger Farm shall not be responsible for unauthorised access arising from the User’s failure to safeguard their OTP, device or account credentials, except to the extent such responsibility cannot lawfully be excluded.
3Scope of Services
3.1The Application facilitates the placement of food and beverage orders from participating Burger Farm outlets for the following services, where available:
- aTakeaway orders;
- bDine-in orders; and
- cMobile Drive-Thru orders.
3.2The Application does not offer home delivery under these Terms. Users shall collect their orders from the selected outlet in accordance with the applicable collection instructions.
3.3The menu, product descriptions, prices, taxes, offers and availability may vary from one outlet to another and may change from time to time without prior notice, subject to applicable law.
3.4The availability of any product, service or ordering mode shall be determined by the selected outlet. Display of a product on the Application does not guarantee its availability at the time of ordering.
4Placing and Acceptance of Orders
4.1An order submitted through the Application constitutes a request by the User to purchase the selected products from the relevant Burger Farm outlet.
4.2Submission of an order does not, by itself, constitute final acceptance of the order. An order shall be treated as accepted once it is confirmed by the relevant outlet and the corresponding order status is displayed in the Application.
4.3The User shall review the selected products, quantities, applicable charges, discounts and payment details before placing the order. The total amount displayed at the “Place Order” stage shall be the amount charged for that transaction, subject to any subsequent refund, reversal or adjustment permitted under applicable law and the applicable policies.
4.4Prices and applicable GST shall be reflected in the order summary or bill, as applicable. A platform fee may be charged for certain transactions, together with GST at the applicable rate, including eighteen per cent (18%) where applicable. Any such fee and applicable tax shall be disclosed to the User before payment.
4.5Burger Farm reserves the right to refuse, reject or cancel an order where reasonably necessary, including in cases of product unavailability, outlet closure, technical errors, suspected fraud, payment irregularities, misuse of the Application or other legitimate operational or legal reasons. Any refund arising from such cancellation shall be processed in accordance with the Refund and Complaint Policy and applicable law.
5Ordering Restrictions
5.1Dine-in orders may be placed only when the User is located within a radius of five (5) kilometres of the selected outlet, subject to the Application’s location-verification mechanism and the availability of the dine-in service.
5.2Certain order categories or services may require online payment and may not permit cash payment. The permitted payment methods shall be displayed in the Application at the time of placing the order.
5.3Only one active order per account shall be permitted at a time, as determined by the Application’s order-status mechanism.
5.4Users shall not attempt to circumvent location restrictions, order limits, payment requirements or other technical and operational controls implemented by Burger Farm.
6Payment Terms
6.1Subject to availability at the selected outlet, the Application may support the following payment methods:
- aUnified Payments Interface (UPI);
- bDebit cards and credit cards;
- cNet banking;

6.2Online payments may be processed through third-party payment service providers, including Razorpay and Cashfree, or such other payment providers as may be integrated into the Application from time to time.
6.3The User agrees to comply with the applicable terms of the relevant payment provider. Burger Farm shall not be responsible for interruptions, failures or delays attributable to a payment provider, bank, payment network or telecommunications service, except to the extent required under applicable law.
6.4If payment is deducted but the order is not successfully placed or confirmed, the applicable amount shall be refunded or reversed in accordance with the Refund and Complaint Policy. The timing of credit to the User’s account may depend on the relevant bank, payment provider or payment method.
6.5The use, balance, validity, restrictions and refunds relating to the Farm Wallet shall be governed by the separate Farm Wallet Terms and Conditions.
7Order Collection and Mobile Drive-Thru
7.1The User shall collect the order from the selected outlet within the collection window communicated through the Application or by the outlet.

7.3In the case of Mobile Drive-Thru orders, the User shall provide accurate vehicle details wherever requested. The order shall be handed over to the vehicle identified in the relevant order, subject to verification by the outlet.
7.4If an order is not collected within the applicable collection window, the outlet may handle the uncollected order in accordance with the applicable uncollected-order policy, food-safety requirements and applicable law. The consequences of non-collection, including any refund eligibility, shall be governed by the policy communicated by Burger Farm.
8Order Cancellation and Complaints
8.1Once an order has been placed, the User shall not be entitled to cancel it through the Application, as preparation or processing may commence immediately after the order is submitted.
8.2If the User experiences an issue involving incorrect items, missing items, food quality, non-receipt of an order or any other order-related concern, the User may submit a complaint through the Support/Help section of the Application or through the official email or telephone contact details communicated by Burger Farm.
8.3Burger Farm may investigate the complaint, including by verifying the order details with the relevant outlet, and may provide an appropriate resolution, including a full or partial refund, replacement or other remedy, where justified under the applicable policy and law.
